Agreement
These Terms of Service (“Terms”) are a binding agreement between you and Doga Cimen (“Amber,” “we,” “us,” or “our”) regarding the Amber iOS app and website at https://amberhabit.app (the “Services”). By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility
You must be at least 13 years old to use Amber. If you are under the age of majority where you live, you may only use the Services with a parent or guardian’s consent. The Services are intended for personal, non-commercial use unless we agree otherwise in writing.
Your account
You sign in with an email magic link. You are responsible for maintaining access to that email and for activity on your account. Do not share access with others. Notify us at support@amberhabit.app if you suspect unauthorized use. You may delete your account in Settings; deletion is permanent and removes associated content as described in the Privacy Policy.
User content
You may submit photos, notes, handles, messages, and other content (“User Content”). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute User Content solely to operate and improve the Services (including showing content to friends, referees, and feed viewers as the product allows).
You represent that you have the rights to submit User Content and that it does not violate law or others’ rights. You agree to follow our Community Guidelines. We may remove content or suspend accounts that violate these Terms or the Guidelines. Report and block tools are available in-app; we aim to review reports within 24 hours.
Amber Pro & billing
Core Amber features are available without payment. Amber Pro is an optional auto-renewing subscription that unlocks additional benefits (including higher weekly token grants and no wallet cap). Prices and durations are shown in the App Store at purchase.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period in your Apple ID account settings.
- Refunds are handled by Apple under Apple’s policies — contact Apple Support or manage purchases in Settings → Apple ID → Subscriptions.
- Use Restore Purchases in the app if Pro status does not appear after buying or reinstalling.
Tokens & stakes
Tokens are a virtual in-app currency with no cash value. They are granted within the app, cannot be purchased separately, and cannot be redeemed for money, transferred out of the app, or sold.
Staking is optional. Each token you stake on a goal provides coverage for one missed window of that habit — a day, a week, or a month, depending on how often the habit runs:
- If you miss a window while coverage remains, one token is consumed and the miss is otherwise absorbed — your gem is unchanged and your streak pauses rather than resetting.
- If you miss a window with no coverage remaining, the ordinary penalty applies: your streak resets. The gem does not lose progress.
- Staked tokens cannot be un-staked or reduced once placed.
- Coverage you never used is returned to your wallet when a goal is completed. Coverage is not returned if you forfeit a goal.
We may change token grants, costs, coverage rules, and other economy rules over time.
AI verification
AI-assisted verification of check-in photos is a convenience feature. It may be incorrect, delayed, or unavailable. Human referees and self-paced modes may produce different outcomes. You remain responsible for honest check-ins. Circumventing verification or submitting misleading evidence violates these Terms.
Not medical advice
Amber is a habit and accountability tool. It is not medical care, therapy, counseling, or a crisis service. It does not diagnose or treat any condition. If you are in crisis or need emergency help, contact local emergency services immediately.
Intellectual property
The Services — including software, design, gems engine, branding, and content we provide — are owned by Doga Cimen or our licensors. You may not copy, reverse engineer, scrape, or exploit the Services except as allowed by law or with our written permission.
Apple App Store
If you download Amber from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation; any claims related to the app are our responsibility, not Apple’s. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GEMS, STREAKS, OR AI OUTCOMES WILL MEET YOUR EXPECTATIONS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOGA CIMEN AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, TOKENS, PROGRESS, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate access if you violate these Terms, create risk for others, or if we discontinue the Services. Provisions that by their nature should survive (including IP, disclaimers, and liability limits) will survive termination.
Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Courts located in the Province of Ontario, Canada will have exclusive jurisdiction over disputes, except where prohibited by law. If any provision is unenforceable, the rest remains in effect.
